Terms of Service

1. Acceptance

By using ForensicMark (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users of the free tier and all API key holders.

2. Lawful use only

You may use the Service only for lawful purposes. Prohibited uses include but are not limited to:

• Processing images that are illegal in your jurisdiction or the jurisdictions you serve
• Non-consensual intimate imagery (NCII) of any kind
• Content that constitutes defamation, harassment, or credible threats of violence
• Circumventing the watermarking or detection systems of third parties without authorization
• Using the Service to build a competing watermarking product that reverse-engineers our model outputs

We reserve the right to determine in our sole discretion whether use violates these terms.

3. Free tier limitations

The free tier is rate-limited and provided "as-is." We make no uptime guarantees for the free tier. Rate limits may change at any time. We reserve the right to block IP addresses that exhibit abusive patterns (automated scraping, limit evasion, denial-of-service attempts). The free tier is not covered by any SLA.

4. API keys

API keys are issued for use by the named entity that requested them. You may not share, resell, or redistribute your API key. If your key is compromised, notify us immediately at hi@forensicmark.com and we will issue a replacement. Usage under your key is your responsibility.

5. No reverse engineering

You may not attempt to reverse-engineer, decompile, or extract the neural watermarking model weights or decoder logic from the Service's outputs, network traffic, or any other means. You may not use ForensicMark outputs to train a model that replicates the watermarking or detection functionality.

6. Intellectual property

You retain all rights to images you submit. We claim no ownership over your content. The watermarks and C2PA manifests we attach are your data — we do not retain copies server-side. The ForensicMark API, model, and software are our intellectual property and may not be reproduced without permission.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that watermarks will survive every possible image transform, that the Service will be error-free, or that detection results are legally admissible evidence in any particular jurisdiction. Use of watermarks and C2PA manifests as evidence should be reviewed by qualified legal counsel.

8. Limitation of liability

To the maximum extent permitted by law, ForensicMark and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the fees paid by you in the 3 months prior to the claim (which may be $0 for free tier users).

9. Abuse and termination

We reserve the right to suspend or terminate access to the Service, with or without notice, for any user we determine is violating these terms, abusing the infrastructure, or acting in ways that damage the Service or other users. API key holders may be notified before termination where practical.

10. Changes to these terms

We may update these terms at any time. Continued use of the Service after a change constitutes acceptance of the new terms. Material changes will be noted with an updated "Last updated" date.
